This is a comment on Gómez-Torrente’s approach to natural kinds and natural kind terms. Here I will focus on his concerns related to the arbitrariness argument and his attempt to formulate a reply to it that maintains most of the “Kripke-Putnam orthodoxy” when it comes to the reference-fixing of such terms. Gómez-Torrente concludes that ordinary kind terms have distinct referents from scientific terms. I will challenge one of the premises that he employs in reaching this conclusion: namely, that the difference (...) in determinacy profiles between ordinary natural kinds and scientific kinds is enough to assume that the terms referring to them do not share their referents. I also suggest that some kind of contextual interpretation of natural kind terms might provide a nice explanation of those determinacy variations. (shrink)

Thainá Demartini has criticized my view that ordinary natural kind terms refer to vague non-scientific kinds and defended the more traditional view that they refer to precise kinds discovered by science. In this note I reject Demartini’s worries as based on inadequate ontological scruples.

This paper explores, first, the common law principles of personal injury litigation explored through court decisions relating to sports injuries in (primarily) England and Wales and, second, the statutory schemes relating to concussion liability and young players in the United States. It explores the difficulties of using those strategies as a means of establishing liability for injuries arising from sports-related concussion (SRC) and explains why they are of such limited utility. While proposed class actions over historically acquired injuries or individual (...) litigation over recent catastrophic injury may have some merit, and while future amendments to the US laws might remove some of their inherent flaws, the difficulties in establishing liability for personal injury will always be exacerbated by the specific characteristics of SRC and the legal, factual and evidential issues that arise. For those reasons, the paper considers the potential benefits of other means of concussion prevention and mitigation, including no-fault compensation and mandatory insurance, the more widespread use of effective, nuanced concussion protocols, and inter-disciplinary research that engages with doctrinal legal research. Este trabalho tem por objetivo analisar a figura de Rosa Luxemburgo como exemplo de ascensão das mulheres ao espaço público tal qual descrito por Hannah Arendt, e refletir sobre os motivos que permitiram seu negligenciamento histórico. Tendo em vista que apesar de ter tido grandes contribuições teóricas e práticas e ter ascendido ao espaço público, ainda assim Rosa Luxemburgo fora negligenciada, estereotipada por meio da figura ora sanguinária, ora romantizada, e por esses motivos Arendt acredita que a política alemã não (...) obteve o reconhecimento devido que mereceria nem em vida e nem em morte. Para tanto, utilizaremos a distinção entre espaço público e espaço privado de Arendt, presente na obra _A condição humana,_ bem como seu ensaio intitulado “Rosa Luxemburgo: 1871-1919”, presente na obra _Homens em tempos sombrios_ _ _e a obra _Rosa Luxemburgo ou o Preço da Liberdade_ de Jörn Schütrumpf_. _Por fim, corroboramos com Hannah Arendt e trazemos também Jörn Schütrumpf para reafirmar que apesar de ter ocorrido uma pequena mudança em sua reputação, e algumas pessoas até saberem o nome de Rosa Luxemburgo, diante de sua grande contribuição teórica e prática seu reconhecimento acadêmico e político ainda é insuficiente, e acreditamos ainda ser possível um reconhecimento ainda que tardio da importância da figura de Rosa Luxemburgo para o pensamento teórico/filosófico político contemporâneo. Introduction: The actions taken by the government to deal with the consequences of the coronavirus diseases 2019 pandemic caused different levels of restriction on the mobility of the population. The need to continue offering physical exercise to individuals after stroke became an emergency. However, these individuals may have barriers to adhere to the programs delivered remotely. There is a lack of evidence related to adherence, attendance, safety, and satisfaction of remote exercise programs for this population.Objective: The aim was to evaluate (...) adherence and barriers to attend a remote physical exercise program for individuals after stroke. We aimed to identify adherence and attendance rate of the remote physical exercise program ; to identify the safety of a remote physical exercise program ; and to identify the overall experience to participate in a remote program.Materials and methods: This is a longitudinal study, including 36 stroke survivors who already attended a face-to-face physical exercise program prior to the COVID-19 pandemic. The remote physical exercise program included sessions for 2 days/week for a duration of 22 weeks, with a total of 44 sessions, which were delivered asynchrony via recorded video sessions. As outcome measures, we performed two questionnaires to identify attendance, barriers, safety, and overall experience related to the program.Results: The adherence rate was 86. The attendance rate was 19, with a total of 8 sessions. The main barriers for lower attendance rate were as follows: lack of motor skills and physical fitness to workout in 80 reports, followed by no exercise companion in 44 reports. The remote physical program has been shown to be safe, and the overall experience was positive from the perspectives of the participants and the family members.Conclusion: Although the adherence rate was high, the attendance rate was low on the remote physical exercise program. The main barriers to attending the program remotely reflect the need of tailoring individually an asynchrony mode of delivering the sessions to individuals after stroke. Our results also indicate how the COVID-19 impacted the health conditions of stroke survivors. The program was safe, and the overall experience indicated a change in the mental, physical, and social health of individuals after stroke and their family members. (shrink)
